OLYMPIA – A judge ordered mixed martial arts champion Jeff Monson to surrender his passport today after he entered a not-guilty plea to spray-painting an anarchist symbol on the state Capitol last year. The order that Monson surrender his passport within 24 hours throws into doubt whether he will be able to appear for two overseas fights. Monson, 38, has a fight scheduled in February in St. Petersburg, Russia. and in March in Tokyo, Japan. After Deputy Prosecuting Attorney Joe Wheeler asked that Monson surrender his passport during Monson’s arraignment Tuesday, Monson leaned over and whispered to Wheeler, "are you going to support my family now?"
Monson's attorney, Legrand Jones, said he will file a motion to release Monson's passport and enable him to appear for his two scheduled overseas fights. Monson was not taken into custody during Tuesday’s hearing, and he is allowed to remain free after posting $20,000 bail. Wheeler argued in court that Monson is a flight risk, and because of Monson's anarchist beliefs, he "would have very little regard for following the orders of the court." Monson is charged with one count of first-degree malicious mischief, a class B felony carrying a maximum penalty of up to 10 years in prison and a $20,000 fine. He was charged this month, and court records state the charge is partly based on photographs published in a December article of ESPN The Magazine profiling Monson. One photo depicts Monson spray-painting an anarchist symbol on the Capitol. The Washington State Patrol has sought those responsible for spray-painting graffiti on columns on the north side of the Capitol since it was left there Nov. 26. The graffiti included anarchy symbols, a peace symbol, and phrases such as "no war" and "no poverty." Jones argued in court Tuesday that Monson is not a flight risk. He said Monson has lived in Olympia since he was 9, and said Monson was joined in court by his wife of 16 years. They have two children, Jones said. Monson's father is a volunteer Lacey police officer, and his brother is a Kirkland police officer, Jones said. Monson has no prior criminal history, Jones said, and a master's degree that allowed him to find employment as a mental health counselor before he pursued his career in mixed martial arts. Monson, whose fighting nickname is "The Snowman," is a Timberline High School graduate who was on the wrestling team at Oregon State University. In December 2004, he won the Cage Warriors Fighting Champion heavyweight title in Sheffield, England, by defeating Tengiz Tedoradze with a submission hold in the first round. On Dec. 13, 2008, he won a match against Ricco Rodriguez in the Mixed Fight Alliance. There Will Be Blood event in Miami. He is listed as the world grappling champion. In a prior phone interview with The Olympian, Monson took responsibility for leaving the graffiti. He said he left it to protest the war in Iraq and economic inequality. "Every great movement in the United States, from civil rights, women’s rights, the labor movement, has been the result of people standing up and breaking the law, refusing to stand at the back of the bus, refusing to stand aside when the government asks you to get off their property," Monson said. "And now, these people are seen as pioneers. But at the time, they were criminals, they were literally criminals. I'm not here to advocate for myself. at some point you have to stand up." Thurston County Superior Court Judge Anne Hirsch said she considered the nature of Monson’s charge — leaving graffiti on the Capitol — and Monson’s pending criminal charge in North Carolina in deciding to ask that he surrender his passport. Monson was arrested Jan. 17 in Davie County, North Carolina, in suspicion of misdemeanor assault and property damage during an argument with a woman. The woman, who was uninjured, also was arrested during the incident for taking Monson's cell phone. Monson returned to the Olympia area last week after posting bail from custody in North Carolina. WASHINGTON (CNN) -- The passport file of any American could be exposed, but there have been only a few breaches of the Passport Office's security system, State Department spokesman Sean McCormack said Friday.
Those few incidents were likely imprudent curiosity, he said. I don't have exact numbers for you, but every single year there's probably a handful of cases where you have unauthorized access to passport data, McCormack told a news briefing. The issue of exposed passport files came to light during the past two days as the State Department revealed the files of the three presidential contenders, Sen. Barack Obama, D-Illinois, Sen. Hillary Clinton, D-New York, and Sen. John McCain, R-Arizona, had been accessed without authorization. A State Department source said passport files contain scanned images of passport applications, birth date and basic biographical information, records of passport renewal and possibly citizenship information. McCormack called the incidents inexplicable and over the line. He said whatever the circumstances, those responsible had ample warning to stay out of the files.

This person chose Sen. Clinton's name. It was immediately recognized, they were immediately admonished. And it didn't happen again, he said. The circumstances of the Obama and McCain incidents were under investigation. In each instance, a computer-monitoring system, triggered when employees access the file of a high-profile person, caught the breaches, McCormack said, emphasizing the department's system worked. He said lower-level managers had thought they had taken care of the problems and did not report them to senior levels in the State Department.
The Federal Court of Appeal has upheld the foreign affairs minister's power to deny a passport to an Algerian-Canadian who spent four years in a French prison for his involvement in a terror network. The three-member appeal court in Ottawa unanimously ruled on Thursday that the government's decision to refuse Fateh Kamel of Montreal a passport was a justifiable violation of his constitutional rights. It reverses a federal court judge's decision last March that the passport office's rejection of his application was unconstitutional. Kamel, a shopkeeper of Algerian origin, was sentenced to eight years in prison in 2001 for directing a terrorist cell called Armed Islamic Group in France that was responsible for a series of bomb attacks in 1995 and the hijacking of an Air France passenger jet a year earlier. The group is also linked to Ahmed Ressam, the man dubbed the "Millenium Bomber" who was convicted of a plot to bomb the Los Angeles airport on New Year's Eve 1999. Kamel was released for good behaviour after serving only four years and subsequently returned to Montreal. He has denied the allegations against him.

I had considered buying the Case Logic one but several reviews stated that it was larger than the [newer, smaller] drives and so the drive could move about a bit inside the case. Struggling with a deluge in passport applications, the State Department did what much of the government does to deal with a manpower crunch. It hired more private contractors. But the practice of outsourcing allowed hired hands to snoop around in presidential candidates' files. And now it's pointing to questions about whether outside contractors should have access to such sensitive information about any citizen. The nation has needed to use nongovernment workers as well as federal employees from its earliest days, Rep. Solomon Ortiz, D-Texas, said this month in a congressional hearing that focused on military contracting. But he asked, "Have we gone too far in recent years by perhaps relying too much on contractors?" The government routinely relies on private firms to do sensitive work from managing weapons systems to protecting traveling diplomats to helping maintain records that contain private information on U. S. citizens. The Bush administration in particular has embraced the practice of outsourcing as a way to save money and improve efficiency, particularly in Iraq where there are just as many defense contractors as there are service members.
With the influx of contractors come increasing questions about lack of control. The State Department, for example, has had to defend its employment of private security guards after several Blackwater Worldwide employees were involved in shootings that left Iraqis dead. Then, last week, contractors were found to have pried into the passport files of Democratic presidential candidate Barack Obama and Republican rival John McCain. Two contractors were fired and a third disciplined. Democrat Hillary Rodham Clinton's files also were breached when a State Department worker used the senator's name during a training session and was reprimanded, officials said. The worker was a government employee and not a contractor. The State Department's inspector general is expected to determine whether the files of other high-profile people were breached and if the searches involving the presidential candidates were politically motivated.
WASHINGTON, Jan. 14 (UPI) -- Another U. S. State Department employee pleaded guilty to illegally accessing confidential passport files, the Justice Department said. Dwayne Cross, 41, of Upper Marlboro, Md., pleaded guilty Wednesday before a magistrate in U. S. District Court for the District of Columbia to a charge of unauthorized computer access, the Justice Department said in a news release. In his plea, Cross admitted that between January 2002 and August 2007, he logged onto the Passport Information Electronic Records System database and looked at passport applications of more than 150 actors, musicians, comedians, models, politicians, athletes, among other applicants. Cross, working as a contract employee at the State Department, admitted he had no official reason to access and view the applications and that his reason was driven by curiosity. Cross is the second former State Department employee to plead guilty in the investigation. Lawrence Yontz, a former Foreign Service Officer and intelligence analyst, pleaded guilty in September to unlawfully accessing hundreds of confidential passport files. He was to 12 months of probation and ordered to perform 50 hours of community service. Cross is to be sentenced in March, the Justice Department said.

New Delhi. Monica Bedi is to be produced in Hyderabad Court, in connection with a case for obtaining passport under a fictitious name. Special Public Prosecutor for CBI, R P Dwivedi had requested the court for Monica's transit remand to Hyderabad. Agreeing to the Dwivedi's request, Bedi said she didn't require an advocate. The Mumbai court judge ordered her to be remanded till she was produced in the Hyderabad Court on or before Monday, Nov 14. The court also directed the CBI to ensure adequate care was taken with regards to Monica Bedi's health while she was in custody. The police and revenue officials at Kurnool in Andra Pradesh had cleared the passports applications of Abu Salem and Monica Bedi under fictitious names of Ramil Kamal Malik and Sana Malik Kamal in 2001.However, only Bedi is likely to be brought to Hyderabad as she was found travelling with the fake passport in Lisbon. Bedi has been booked under Sections 420, 471 of IPC and under the Passport Act 1967, which states that it is an offense to give false information in the passport application. Four government employees, including an assistant sub-inspector and a revenue employee in Kurnool have been suspended for connivance in this case. After the Hyderabad Court hearing, Bedi is to be taken to Bhopal for the questioning trial for another fake passport that she obtained from here.

Travel agent Manjit Singh, one of the prime accused in the Moga passport scandal, was on Sunday arrested by Punjab police. Singh, who had been absconding since the case was registered on July 23 last year, was nabbed while he was trying to enter a resort to join a marriage party, police said. Police had on January 23 filed a chargesheet against three of the accused Moga policemen Gurdial Singh, Ranjit Singh and Jaswinder Singh and Bhupinder Singh Brar, a travel agent from Dharamkot, in a Faridkot court in the case. The accused allegedly secured more than 400 passports based on forged documents in Moga during a two-year period with the connivance of officials of the Regional Passport Office though the applicants belonged to other districts. The case was registered on the complaint of a former serviceman Harbax Singh of Chandigarh who had sought information under the Right to Information Act. Harbax had sought to know how the accused got a fake passport made in the name of Gurpreet Singh, a resident of Ghuman village of Gurdaspur district who had gone to France about five years back, on a fake address. The kingpins of passport scam- head constables Ranjit Singh and Jaswinder Singh-- in connivance with Manjit Singh allegedly applied for a passport in the name of Gurpreet after submitting forged documents and later received passport with the help of postman on fake address. Postman Om Prakash of Baghapurana was arrested on July 24 last year.
Hyderabad. A city court Thursday framed charges against mobster Abu Salem in a fake passport case and adjourned the trial to Feb 27. The special court for the Central Bureau of Investigation (CBI) cases framed the charges against Abu Salem. These include criminal conspiracy, forgery, impersonation and cheating as defined in various sections of the Indian Penal Code (IPC) and the Passport Act. Abu Salem, who was brought from Mumbai and presented to the court, pleaded that he was implicated in a false case and claimed that he had left India in 1993. Magistrate Raghunath Rao read out the charges against him and later adjourned the case to Feb 27 for trial. He directed the authorities of Arthur Road Jail of Mumbai, where Salem is being detained, to bring him for the next hearing. The magistrate said the trial could commence on Feb 27 if all the original documents pertaining to the case were brought from the Supreme Court. The CBI sought time to present the documents, which were called by the apex court while hearing the bail petition of Monica Bedi, a former actress and girlfriend of Salem. Salem urged the judge that the hearing of the case be expedited. "I have a back problem and am facing a lot of difficulty in travelling up and down. Kindly issue orders for my detention here till the case is disposed of," said Salem, who is also an accused in the 1993 serial Mumbai bomb blasts. The magistrate accepted his request and said he would issue an order in this regard if the trial commences at the next hearing. Salems counsel Pradeep Kumar told reporters that the court framed charges against him under 120 B (criminal conspiracy), 419 (impersonation), 420 (cheating), 468 (forgery) and 471 (using forged documents) of the IPC and 12 (1) B of the Passport Act. Salem also complained to the court about the CBI delaying the trial and pointed out that the case of his co-accused (Monica Bedi and others) was already disposed of. Monica Bedi, who was extradited from Portugal along with Abu Salem in 2005, was sentenced to five years imprisonment in the same case by the CBI court in 2007. The Supreme Court later released her on bail. The CBI filed a case against Salem, Monica Bedi, his first wife Sabeen Azmi and others for procuring passports using fake names and addresses in Kurnool district of Andhra Pradesh in August 2001. Bedis passport was issued in the name of Sana Malik Kamal and Salem got the passport in the name of Ramil Kamal Malik. The fraud was detected in February 2002 when the Intelligence Bureau got a tip-off that Salem and Bedi had used fake passports during a trip to Dubai. Salem and Bedi fled the country after the 1993 blasts in Mumbai, which claimed over 250 lives. After prolonged extradition proceedings, Salem and Bedi were brought to India on Nov 11, 2005. Their cases were separated for speedy trial. Bedi was acquitted by a Bhopal court in a similar case in 2007. (IANS)

Another employee Mohan Lal was arrested in Nalanda on Tuesday. Farhan, an accused in the American Centre shoot out case, claimed to be a resident of Biharsharif, headquarters of Nalanda district, in his passport application form though he has never visited the place. Three Afghan Muslim men caught posing as Mexican nationals last month while en route to Europe were part of a human smuggling operation and carried what now are believed to be altered but genuine Mexican passports for which they paid $10,000 each, Indian investigators told the San Antonio Express-News. An ongoing transcontinental investigation, which now involves Mexican and Indian authorities, began Feb. 11 when a suspicious airport Customs official in Kuwait noticed the three Afghans, traveling under Mexican pseudonyms, couldn't speak Spanish during a layover on their trip from New Delhi, India, to France. The three Afghan travelers were detained and deported to India, where they remain in custody while Mexican and Indian authorities try to learn about their backgrounds, where they were going and who sold the apparently real government-issue passports. A U. S. source confirmed the FBI and Immigration and Customs Enforcement investigators also are looking into the matter. At issue to some U. S. national security experts is whether another of Mexico's foreign embassies might be implicated in selling travel documents to people from countries like Afghanistan where terror organizations are active, a circumstance that potentially could bring terrorists to American borders. It wouldn't be the first time a foreign Mexican embassy was implicated in such an affair. In 2003, a Mexican investigation into a Lebanon-Mexico human smuggling operation produced firings and indictments of Mexican Embassy personnel in Beirut for allegedly selling travel documents to Lebanese citizens. One man who bought a Mexican visa for $3,000 turned out to be a ranking Hezbollah operative smuggled over the California border in the trunk of a car. Mahmud Kourani was convicted in 2004 of supporting the terrorist group from Detroit. Catching U. S.-bound travelers from the Middle East "was our No. 1 concern," said recently retired FBI Assistant Legal Attache James Conway, who for four years after 9-11 oversaw the bureau's counterterrorism programs in Mexico City. "That's the national security concern from our southern flank." Travelers from Islamic countries carrying passports that are valid but altered with fake names and photographs are among the most difficult to detect, he said. In the black markets of human smuggling, real national passports with embedded security bar codes rank among the most valuable travel documents because they enable their bearers to more easily slip through airport inspections. "If you've got a Mexican passport you've already crossed the bridge," Conway said. "And you can become part of the flood of people who cross into the U. S. If terrorists wanted to exploit the infrastructure in place, they can. It's there." V. G. Babu, superintendent of immigration police at New Delhi's Cochin International Airport, told the San Antonio Express-News by phone that the passports were genuine government-manufactured passports and the three men admitted to buying them for $10,000 each in Bombay, which hosts a Mexican consulate office. Babu said the three men initially tried to convince Indian authorities they were Mexicans. But the story quickly fell apart when two of the three couldn't prove they spoke Spanish, he said. "We broke them," because of the language issue, he said, and handed the Afghan citizens over to federal Indian police for further investigation. Whether the Afghans are connected to terrorist organizations battling with American troops in Afghanistan and how they obtained the passports remain unknown as the obscure foreign investigation unfolds. But Afghanistan is one of 43 predominantly Islamic nations listed by the U. S. Department of Homeland Security as "countries of special interest" because al-Qaida or other terror groups operate in them. Many Afghans caught crossing the U. S. southern border in recent years have been determined to be economic immigrants, not terrorists, but many others are presumed to have crossed and not been caught. Between 2002 and 2006, the U. S. border patrol caught about 63 Afghans crossing the borders, according to agency capture data. Conway, the former FBI legal attache to Mexico, said that during his tour the FBI got many "hits" running the names of captured immigrants from those countries through terror watch list databases. He declined to elaborate, citing national security rules against disclosure, and it remains unknown what was learned of those individuals. The India case highlights concern among homeland security officials since 9-11 about a continuing stream of such immigrants from countries of interest who are able to illegally cross U. S. borders every year using Latin American travel documents often provided by paid human smugglers. A chief concern, according to current and former FBI and ICE agents familiar with the issue, is how well Latin American countries police the supplies of travel documents emanating from their embassies and consulates in Islamic countries. According to federal court records from prosecutions of Middle Eastern smugglers, thousands of Iraqis, Syrians, Lebanese and citizens of many other Islamic countries have been able to travel illegally to Latin American countries, then over U. S. borders. They were often able to do so by using real travel documents originating from embassy offices of Mexico, Guatemala, Ecuador, Venezuela, Colombia and Peru. Conway, the retired FBI agent who supervised counterterrorism programs in Mexico, said the ability to obtain real passports from any of those countries represents a high danger. "If you've got diplomatic establishments, like in Beirut, handing out passports, there's little you can do," he said. "They come to Mexico, dress like Mexican businessmen and you think they're going to pop up on our radar screen? Absolutely not. They're going to walk on through." In recent years, U. S. authorities have sought to make Central and South American countries more aware of the security threat presented by their foreign consulates and embassies. But some of those countries, such as Venezuela and Guatemala, have proven less than responsive when asked to tighten controls on foreign service personnel stationed abroad. Among countries south of the U. S., Mexico has proven to be among the most cooperative, Conway and other federal agents who have worked counterterrorism programs there have said. Mexico has collaborated extensively with American agencies to interdict travelers from countries of interest, going so far as to allow American agents to interrogate captured detainees inside Mexican facilities. As part of those efforts, the Mexican government has taken some steps to fortify confidence in its foreign embassy personnel. For instance, after an investigation in 2003 Mexico purged its Beirut embassy of personnel thought to have been supplying travel documents to a Lebanese human smuggling operation run by Salim Boughader, a Lebanese Mexican. Then, after Boughader was convicted in U. S. courts of smuggling hundreds of Lebanese into Mexico and then over the U. S. borders, Mexico prosecuted and convicted him. Mexico also has intensified a program of vetting its foreign consuls and actively monitoring the activities of staff elsewhere. Last year, the Express-News reported that Iraqis and other citizens of the region had offered hundreds of thousands of dollars in bribes to Mexico's honorary consul to Jordan, for travel visas that would get them to Mexico and then the U. S. Raouf N. El-Far, a Jordanian businessman who was appointed Mexico's honorary consul to Jordan in 2004, said he refused all offers. He also said he underwent an intensive intelligence background check before his appointment, part of a new program at the time. Still, word that three Afghans caught using passports to pose as traveling Mexican nationals struck counter-terrorism expert Steven Emerson as lucky -- and alarming. OLYMPIA A judge ordered mixed martial arts champion Jeff Monson to surrender his passport today after he entered a not-guilty plea to spray-painting an anarchist symbol on the state Capitol last year.
The order that Monson surrender his passport within 24 hours throws into doubt whether he will be able to appear for two overseas fights. Monson, 38, has a fight scheduled in February in St. Petersburg, Russia. and in March in Tokyo, Japan. After Deputy Prosecuting Attorney Joe Wheeler asked that Monson surrender his passport during Monsons arraignment Tuesday, Monson leaned over and whispered to Wheeler, "are you going to support my family now?"Monson's attorney, Legrand Jones, said he will file a motion to release Monson's passport and enable him to appear for his two scheduled overseas fights. Monson was not taken into custody during Tuesdays hearing, and he is allowed to remain free after posting $20,000 bail. Wheeler argued in court that Monson is a flight risk, and because of Monson's anarchist beliefs, he "would have very little regard for following the orders of the court."Monson is charged with one count of first-degree malicious mischief, a class B felony carrying a maximum penalty of up to 10 years in prison and a $20,000 fine. He was charged this month, and court records state the charge is partly based on photographs published in a December article of ESPN The Magazine profiling Monson. First there was the thick foreign accent that did not sound anything like North Carolina. Then there were the startling lapses in memory. the man could not name his own brothers and sisters. In the end, it was a story that did not hold water, and a fraud that collapsed into calamity. The man, who was tried before a federal judge in Manhattan on Monday, remains known to the authorities only as ''John Doe.'' His trial before Judge Kevin Thomas Duffy of Federal District Court lasted less than a hour, and he was convicted of making false statements on passport applications. Federal prosecutors said yesterday that Mr. Doe showed up on Aug. 7, 2002, at the New York Passport Office, seeking a passport under the name of another man. He had a birth certificate, library card and employment identification, all in the name of the other man, whom the authorities would not identify. Immigration officials said Mr. Doe claimed to be a native of North Carolina. That seemed doubtful, both because his accent indicated he might be from the Caribbean, and because of his pitiful lack of knowledge about what he said was his home state. In questioning by agents for the Diplomatic Security Service, a branch of the State Department, Mr. Doe said he had several brothers and sisters, but did not recall how many. Nor could he name any of them. Another man, who participated in the ruse by signing a passport application on Mr. Doe's behalf, and later agreed to testify, described Mr. Doe as an illegal immigrant from Jamaica who wanted a passport so he could travel freely between the United States and his homeland. Mr. Doe has been held since his arrest on Aug. 7, 2002, in the Metropolitan Correctional Center in Manhattan, and was returned there after his conviction on Monday. He is to be sentenced by Judge Duffy on Feb. 23, and faces a maximum sentence of 10 years in prison.

Ahmedabad, May 6. One of the most glaring holes in the Samirkhan Pathan encounter story is the police claim that he had obtained a fake passport in the name of one Nawab Khan from Bhopal and travelled to Pakistan on the same. Based on his confessions, before he was killed in an encounter on October 22, 2002, the police had arrested 12 people and charged them with criminal conspiracy and with waging a war against the country. When the case came up for trial in the Ahmedabad Sessions Court, the prosecution said that on January 13, 1999, Samirkhan travelled from Delhi to Lahore by Samjhauta Express. That while he obtained a tourist visa for a month, it was extended for 15 days. The prosecution added that he joined a training camp in Pakistan, where he learnt to operate sophisticated weapons, and then went to Nepal. From there, they claimed, Samirkhan came to Patna, Mumbai and then Ahmedabad, where he was arrested. However, when Passport Officer of Bhopal T D Sharma was called by the court for questioning, he submitted that the passport in the name of Nawab Khan had been issued in March 1999. That was two months after the prosecutions date for Samirkhans visit to Pakistan.
WASHINGTON, Jan. 14 (UPI) -- Another U. S. State Department employee pleaded guilty to illegally accessing confidential passport files, the Justice Department said. Dwayne Cross, 41, of Upper Marlboro, Md., pleaded guilty Wednesday before a magistrate in U. S. District Court for the District of Columbia to a charge of unauthorized computer access, the Justice Department said in a news release. In his plea, Cross admitted that between January 2002 and August 2007, he logged onto the Passport Information Electronic Records System database and looked at passport applications of more than 150 actors, musicians, comedians, models, politicians, athletes, among other applicants. Cross, working as a contract employee at the State Department, admitted he had no official reason to access and view the applications and that his reason was driven by curiosity. Cross is the second former State Department employee to plead guilty in the investigation. Lawrence Yontz, a former Foreign Service Officer and intelligence analyst, pleaded guilty in September to unlawfully accessing hundreds of confidential passport files. He was to 12 months of probation and ordered to perform 50 hours of community service. Cross is to be sentenced in March, the Justice Department said.

But he did say his government has applied strong measures and invested considerable resources to continuously improve the security of its travel documents. Mexico is a committed partner with the U. S. in ensuring our borders are not used to threaten or undermine our common security, Alday said in an e-mail. Whether the Afghans are connected to terrorist organizations battling with American troops in Afghanistan and how they obtained the passports remain unknown as the obscure foreign investigation unfolds. But Afghanistan is one of 43 predominantly Islamic nations listed by the U. S. Department of Homeland Security as countries of special interest because al-Qaida or other terror groups operate in them. Many Afghans caught crossing the U. S. southern border in recent years have been determined to be economic immigrants, not terrorists, but many others are presumed to have crossed and not been caught. Between 2002 and 2006, the U. S. border patrol caught about 63 Afghans crossing the borders, according to agency capture data. Conway, the former FBI legal attache to Mexico, said that during his tour the FBI got many hits running the names of captured immigrants from those countries through terror watch list databases. He declined to elaborate, citing national security rules against disclosure, and it remains unknown what was learned of those individuals. The India case highlights concern among homeland security officials since 9-11 about a continuing stream of such immigrants from countries of interest who are able to illegally cross U. S. borders every year using Latin American travel documents often provided by paid human smugglers. A chief concern, according to current and former FBI and ICE agents familiar with the issue, is how well Latin American countries police the supplies of travel documents emanating from their embassies and consulates in Islamic countries. According to federal court records from prosecutions of Middle Eastern smugglers, thousands of Iraqis, Syrians, Lebanese and citizens of many other Islamic countries have been able to travel illegally to Latin American countries, then over U. S. borders. They were often able to do so by using real travel documents originating from embassy offices of Mexico, Guatemala, Ecuador, Venezuela, Colombia and Peru. Conway, the retired FBI agent who supervised counterterrorism programs in Mexico, said the ability to obtain real passports from any of those countries represents a high danger. If you've got diplomatic establishments, like in Beirut, handing out passports, there's little you can do, he said. They come to Mexico, dress like Mexican businessmen and you think they're going to pop up on our radar screen? Absolutely not. They're going to walk on through. In recent years, U. S. authorities have sought to make Central and South American countries more aware of the security threat presented by their foreign consulates and embassies. But some of those countries, such as Venezuela and Guatemala, have proven less than responsive when asked to tighten controls on foreign service personnel stationed abroad. Among countries south of the U. S., Mexico has proven to be among the most cooperative, Conway and other federal agents who have worked counterterrorism programs there have said. Mexico has collaborated extensively with American agencies to interdict travelers from countries of interest, going so far as to allow American agents to interrogate captured detainees inside Mexican facilities. As part of those efforts, the Mexican government has taken some steps to fortify confidence in its foreign embassy personnel. For instance, after an investigation in 2003 Mexico purged its Beirut embassy of personnel thought to have been supplying travel documents to a Lebanese human smuggling operation run by Salim Boughader, a Lebanese Mexican. Then, after Boughader was convicted in U. S. courts of smuggling hundreds of Lebanese into Mexico and then over the U. S. borders, Mexico prosecuted and convicted him. Mexico also has intensified a program of vetting its foreign consuls and actively monitoring the activities of staff elsewhere. Last year, the Express-News reported that Iraqis and other citizens of the region had offered hundreds of thousands of dollars in bribes to Mexico's honorary consul to Jordan, for travel visas that would get them to Mexico and then the U. S. Raouf N. El-Far, a Jordanian businessman who was appointed Mexico's honorary consul to Jordan in 2004, said he refused all offers. He also said he underwent an intensive intelligence background check before his appointment, part of a new program at the time. Still, word that three Afghans caught using passports to pose as traveling Mexican nationals struck counter-terrorism expert Steven Emerson as lucky and alarming. If these three Afghanis figured out how to infiltrate under false Mexican identifies, you can be sure that Islamic terrorists have done the same, said Emerson, who runs the Washington-based Investigative Project on Terrorism. This needs to be investigated by Congress and the FBI.

First there was the thick foreign accent that did not sound anything like North Carolina. Then there were the startling lapses in memory. the man could not name his own brothers and sisters. In the end, it was a story that did not hold water, and a fraud that collapsed into calamity. The man, who was tried before a federal judge in Manhattan on Monday, remains known to the authorities only as ''John Doe.'' His trial before Judge Kevin Thomas Duffy of Federal District Court lasted less than a hour, and he was convicted of making false statements on passport applications. Federal prosecutors said yesterday that Mr. Doe showed up on Aug. 7, 2002, at the New York Passport Office, seeking a passport under the name of another man. He had a birth certificate, library card and employment identification, all in the name of the other man, whom the authorities would not identify. Immigration officials said Mr. Doe claimed to be a native of North Carolina. That seemed doubtful, both because his accent indicated he might be from the Caribbean, and because of his pitiful lack of knowledge about what he said was his home state. In questioning by agents for the Diplomatic Security Service, a branch of the State Department, Mr. Doe said he had several brothers and sisters, but did not recall how many. Nor could he name any of them. Another man, who participated in the ruse by signing a passport application on Mr. Doe's behalf, and later agreed to testify, described Mr. Doe as an illegal immigrant from Jamaica who wanted a passport so he could travel freely between the United States and his homeland. Mr. Doe has been held since his arrest on Aug. 7, 2002, in the Metropolitan Correctional Center in Manhattan, and was returned there after his conviction on Monday. He is to be sentenced by Judge Duffy on Feb. 23, and faces a maximum sentence of 10 years in prison.

Struggling with a deluge in passport applications, the State Department did what much of the government does to deal with a manpower crunch. It hired more private contractors. But the practice of outsourcing allowed hired hands to snoop around in presidential candidates' files. And now it's pointing to questions about whether outside contractors should have access to such sensitive information about any citizen. The nation has needed to use nongovernment workers as well as federal employees from its earliest days, Rep. Solomon Ortiz, D-Texas, said this month in a congressional hearing that focused on military contracting. But he asked, "Have we gone too far in recent years by perhaps relying too much on contractors?" The government routinely relies on private firms to do sensitive work from managing weapons systems to protecting traveling diplomats to helping maintain records that contain private information on U. S. citizens. The Bush administration in particular has embraced the practice of outsourcing as a way to save money and improve efficiency, particularly in Iraq where there are just as many defense contractors as there are service members.
With the influx of contractors come increasing questions about lack of control. The State Department, for example, has had to defend its employment of private security guards after several Blackwater Worldwide employees were involved in shootings that left Iraqis dead. Then, last week, contractors were found to have pried into the passport files of Democratic presidential candidate Barack Obama and Republican rival John McCain. Two contractors were fired and a third disciplined. Democrat Hillary Rodham Clinton's files also were breached when a State Department worker used the senator's name during a training session and was reprimanded, officials said. The worker was a government employee and not a contractor. The State Department's inspector general is expected to determine whether the files of other high-profile people were breached and if the searches involving the presidential candidates were politically motivated.

Passport Denial Case Filed by ACLU The ACLU filed a class-action lawsuit Tuesday against the US Department of State for refusing to issue passports to US citizens born by midwives along the US-Mexico border. An ACLU press release explains, "the lawsuit charges that the State Department categorically questions the citizenship of virtually all midwife-delivered Mexican-Americans born in southern border states" by forcing applicants to provide excessive documentation while applying for passports. According to the Washington Post, dozens of midwives in southern Texas have been convicted of issuing fraudulent birth certificates since the late 1960s. However, the children of poor women without access to hospitals are disproportionately questioned about the validity of their birth certificates when seeking passports. This new lawsuit is particularly timely because the
